PUBLIC AGREEMENT (OFFER)

This offer is valid under the condition of registration and payment for the services to the bank details of the Contractor, sent to the person who filled out the registration form via email and/or other means of telecommunication.

Individual Entrepreneur Iryna Dmytrivna Murzhak, acting on the basis of an extract from the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Organizations, record date 21.02.2024, record number: 730304854 (hereinafter referred to as the Contractor), hereby makes this public offer to conclude an agreement on the provision of information and consulting services on the following terms:
1. Subject of the Agreement
1.1. The Contractor undertakes to provide the person who accepted this offer (hereinafter referred to as the Customer and/or User) with information and consulting services in the form of services specified on the corresponding page of the Contractor's website:  http://lobsangkadrin.online/retarmeniaeng (hereinafter referred to as the event and/or Order, and/or services), and the Customer undertakes to accept and pay for these services.
1.2. The services are provided in the form of granting the Customer access to an offline event with the participation of the Contractor and specialists and/or experts engaged by the Contractor, who are highly qualified in the provision of these services.
1.3. The name, format, price, and terms of the service are determined according to the information posted on the Contractor's website at:  http://lobsangkadrin.online/retarmeniaeng (hereinafter referred to as the Website), and the Customer's application, completed on the website during online registration for participation in the Project.
1.4. Acceptance of this offer is considered completed under the condition of preliminary online registration on the Contractor's website for participation in the event and making payment for participation in it.
2. Rights and Obligations of the Contractor
2.1. The Contractor has the right to:
2.1.1. Independently determine the program, volume, and format of the event.
2.1.2. Engage third parties to fulfill its obligations under the agreement;
2.1.3. Require the User to present identification documents and provide other data identifying the User, in cases provided for by the conditions of the relevant events or the legislation of Russia. In case of failure to provide documents or discrepancy of information therein, the Contractor has the right to refuse the User the provision of services.
2.1.4. Recover from the Customer damages in full in case of the Customer's violation of the terms of this Agreement.
2.1.5. In case of the Customer's violation of the terms of this Agreement, including clause 3.3., the Contractor has the right to unilaterally suspend the provision of services under this agreement without refund of funds.
2.2. The Contractor is obliged to:
2.2.1. Enroll the Customer in the group of Project participants after acceptance of this offer in accordance with the terms of this Agreement.
2.2.2. Organize and ensure the proper provision of services stipulated in clause 1 of this offer.
2.3. The Contractor is not responsible for inaccurate or erroneously entered data during registration, as a result of which the Customer did not receive a letter or SMS message from the Contractor, as well as in case these notifications were not delivered due to provider blocking, spam filters, and other factors beyond the Contractor's control.
3. Rights and Obligations of the Customer
3.1 The Customer has the right to:
3.1.1. Demand proper performance by the Contractor of its obligations.
3.1.2. Refuse this Agreement in accordance with clause 5 of the Offer.
3.2. The Customer undertakes to:
3.2.1. Pay for the Contractor's services in the amount and within the terms provided for in this offer.
3.2.2. Refrain from recording the event and distributing it (in any form, including posting on the Internet) without the consent of the Contractor.
3.2.3. Provide reliable and, if necessary, complete information when using the Website, fill in the registration data, indicating their full name, phone number, and email.
3.2.4. Independently verify the Order data before placing it. The Customer bears full responsibility for the accuracy and correctness of the data used when placing the Order.
3.2.5. Familiarize themselves with the content, registration conditions, and procedure for providing services, as well as with additional requirements imposed by the Contractor before placing the Order. If the Customer does not understand any conditions for the provision of services under this Agreement, including the payment procedure, the Customer undertakes to clarify these conditions, and if it is impossible to clarify, refuse to place the Order and receive services.
3.2.6. Follow all instructions and prescriptions provided by the Contractor within the framework of providing services under this Agreement.
3.3. Liability of the Parties
3.3.1. Under no circumstances shall the Contractor be liable to the Customer or third parties for any damage related to the use of the Website, the content of the Website, or other materials accessed through the Website.
3.3.2. The Contractor is not liable to the Customer if the Customer:
a) violated the terms and conditions of payment under this Agreement and/or
b) did not use the Contractor's services within the terms communicated by the Contractor on the corresponding page of the Website and/or by email and/or by other means of telecommunication;
3.3.3. The Contractor is not responsible for violation of the terms of the agreement in case the Customer provides inaccurate and/or incomplete information about themselves when placing the order, including contact information (e-mail, phone, etc.), as well as in case the Customer does not provide new contact information (e-mail, phone).
3.3.4. The Contractor is liable for violation of the terms of the agreement solely in case of improper performance due to its fault.
3.3.5. The Contractor is not responsible for modifications and changes to the training program and class schedule.
3.3.6. The Customer is responsible for planning the time for attending the event. The Contractor is not responsible for the Customer's non-attendance at the event if the Contractor has properly performed its obligations.
4. Payment for Services
4.1. The provision of services under this Agreement is carried out by the Contractor based on the Customer's preliminary registration by filling out the online registration form on the Website and subsequent payment for participation in the event. The price for participation in the event is determined on the corresponding page of the website.
4.2. Payment is made by non-cash transfer to the Contractor's bank account in full before the start of the event. Upon completion of the online registration process, the Customer will be provided with the opportunity to pay for participation by the following methods: bank card; transfer, or others. The choice of one of the specified payment forms belongs to the Customer.
Payment by a third party on behalf of the Customer is allowed with mandatory notification of the Contractor.
4.3. In case of the Customer purchasing services under this Agreement, payment may be made in installments, namely: in equal amounts monthly, but no later than April 1. The parties may agree on a different payment procedure for services under this Agreement.
4.4. All bank commissions withheld by the bank directly involved by the Customer for transferring funds to the Contractor are borne by the Customer (paid by them at their own expense).
5. Termination of the Agreement and its Consequences
5.1. Either party has the right to unilaterally refuse the agreement before the start of the provision of services under this agreement.
5.2. In case of cancellation of the event due to the fault of the Contractor, the refund of funds is made within 5 (five) banking days from the date the Contractor receives the Customer's application for a refund indicating the necessary bank details. In this case, the refund request must be sent by the Customer to the Contractor at the Contractor's email address: murzhakirina@gmail.com.
The Contractor refunds the funds to the Customer minus the commission.
5.3. In case of the Customer not receiving the service not due to the fault of the Contractor or the Customer's disqualification from participation in the event (service) due to a violation of this Agreement and/or the Customer's unilateral refusal, the funds paid by the Customer for the service are not refunded and no compensation is provided.
6. Personal Data
6.1. The Customer gives consent to the collection, systematization, accumulation, storage, clarification (updating, modification), use, depersonalization, blocking, destruction of the following personal data provided to the Contractor when concluding this agreement: surname, name, patronymic, date of birth, registration address, phone number, and email address. This consent is given for an indefinite period.
6.2. The User gives consent to the processing of personal data, both without the use of automation tools and with their use.
6.3. The purposes of processing personal data are the Contractor's fulfillment of the terms of this agreement, as well as conducting advertising campaigns and marketing research.
6.4. The transfer of personal data to third parties is carried out in accordance with the current legislation of Russia and agreements between the Contractor and the User.
6.5. Consent may be withdrawn by the User by sending a written application to the Contractor at the email address specified on the Website after the expiration of the agreement.
7. Other Conditions.
7.1. All disputes under this agreement are subject to consideration in the state courts of Russia in accordance with the current procedural legislation of Russia.
7.2. In case of improper performance or non-performance of their obligations under the agreement, the parties bear responsibility in accordance with the civil legislation of Russia.
